1. Overview
1.1 The Chef’s Circle and Chef’s Circle VIP programs (together, the Chef’s Circle Program) are loyalty recognition programs offered by My Muscle Chef Pty Ltd (ABN 92 162 190 070) (MYMC, we, us).
1.2 The Chef’s Circle Program is designed to recognise and reward eligible customers based on their qualifying spend and engagement with MYMC.
1.3 These Terms & Conditions form part of, and should be read together with, MYMC’s standard Terms & Conditions (available at www.mymusclechef.com/terms) and MYMC’s Privacy Policy (available at www.mymusclechef.com/privacy). In the event of any inconsistency between these Terms and the standard Terms & Conditions, these Terms will prevail to the extent of the inconsistency, but only in respect of the Chef’s Circle Program.
2. Eligibility & Membership
2.1 Customers may be included in the Chef’s Circle Program by invitation or automatically upon meeting the qualifying spend thresholds.
2.2 Customers may qualify for the following tiers:
- Chef’s Circle: Customers who spend $3,000 or more in eligible purchases within a rolling 12-month period.
- Chef’s Circle VIP: Customers who spend $6,000 or more in eligible purchases within a rolling 12-month period.
2.3 Eligible spend is measured on a net basis — that is, the actual amount paid by the customer for MYMC products purchased through the MYMC online platform (www.mymusclechef.com and the MYMC mobile app), after applying any discount, promotion, voucher, gift card or account credit.
2.4 For the avoidance of doubt, eligible spend:
- includes amounts actually paid by the customer for MYMC products ordered through the MYMC online platform;
- excludes shipping and delivery fees;
- excludes the value of any discount, promotional code, referral credit or account credit applied to the order (so that only the net amount paid by the customer is counted);
- excludes the value of any account credit issued to the customer by MYMC in connection with an order (for example, as compensation for a short delivery, damaged product or service issue), to the extent that credit reduced the amount the customer actually paid for that order; and
- excludes purchases of MYMC products made through third parties or retail channels outside the MYMC online platform, and any purchases from related brands (including Chefgood), which do not contribute to Chef’s Circle qualifying spend.
2.5 Where a refund is issued to the customer in respect of an order, the refunded amount will be deducted from the customer’s qualifying spend and the customer’s tier status will be recalculated accordingly.
2.6 MYMC reserves the right to determine eligibility at its sole discretion, including verification of qualifying spend.
3. Tier Status & Duration
3.1 Once a customer qualifies for a Chef’s Circle tier, their status is valid for 12 months from the date of qualification.
3.2 During the 12-month period:
- Customers will not be downgraded regardless of subsequent spend.
3.3 At the end of the 12-month period, the customer’s qualifying spend over the preceding rolling 12 months will be re-assessed and:
- if the customer’s spend is $6,000 or more, they will retain Chef’s Circle VIP status;
- if the customer’s spend is $3,000 or more but less than $6,000, they will retain (or, in the case of a VIP member, be moved to) Chef’s Circle status; and
- if the customer’s spend is less than $3,000, they will be removed from the Chef’s Circle Program.
3.4 Customers may upgrade to a higher tier at any time upon meeting the relevant threshold. The 12-month period resets from the date of upgrade.
4. Program Benefits
4.1 Members may receive access to benefits based on their tier.
Chef’s Circle benefits may include:
- Complimentary products (such as snacks or non-meal items) added to orders;
- Birthday rewards;
- Enhanced referral rewards;
- Priority customer support; and
- Invitations to provide feedback, including via surveys, tastings, or research activities.
Chef’s Circle VIP benefits may include:
- All Chef’s Circle benefits, plus:
- Complimentary meals provided periodically (e.g. as part of campaigns);
- Further enhanced referral rewards; and
- Additional exclusive perks, offers, and experiences.
4.2 Benefits:
- Are non-transferable and not redeemable for cash;
- May be subject to availability, campaign limits, or eligibility conditions; and
- May be varied, substituted, or withdrawn at any time at MYMC’s discretion.
4.3 Certain benefits (including complimentary products and meals):
- Are fulfilled in connection with an active order; and
- Will not be provided separately or retrospectively where no qualifying order is placed, except where MYMC’s failure to fulfil the benefit is due to an event within MYMC’s reasonable control (in which case MYMC will make reasonable efforts to provide the benefit in a subsequent order or provide an equivalent benefit).
5. Complimentary Products & Meals
5.1 Complimentary products (including snacks and meals) may be provided to eligible members at MYMC’s discretion.
5.2 Complimentary meals for Chef’s Circle VIP members:
- May be offered periodically (including as part of quarterly or campaign-based activity), but are not guaranteed; and
- Are subject to availability, campaign limits, and eligibility criteria.
5.3 Complimentary items:
- Will be automatically added to eligible orders where applicable;
- May vary in type, flavour, or product; and
- Cannot be exchanged, transferred, or redeemed for cash.
5.4 If MYMC fails to fulfil a complimentary product or meal due to an event within MYMC’s reasonable control (for example, a picking or packing error on MYMC’s part), MYMC will make reasonable efforts to provide the benefit in a subsequent order or provide an equivalent benefit.
6. Birthday Rewards
6.1 Birthday rewards are available to eligible members who have provided a valid birth date in their MYMC account.
6.2 Birthday rewards:
- Are issued once per calendar year during the customer’s birthday month; and
- Are fulfilled in connection with an active order.
6.3 The form and value of the birthday reward is variable and may be determined by MYMC from time to time. The applicable reward will be communicated to the member at the time of issue.
6.4 Birthday rewards are:
- Non-transferable; and
- Not redeemable for cash or exchange.
7. Referral Benefits
7.1 Chef’s Circle members may receive enhanced referral reward amounts as part of tier-based or promotional offers (for example, “Give $50, Get $30” for Chef’s Circle members or “Give $50, Get $40” for Chef’s Circle VIP members), which may vary from time to time.
7.2 For the avoidance of doubt:
- Chef’s Circle VIP members may receive a higher dollar value referral reward per successful referral than Chef’s Circle members; however
- The volume cap on referrals is the same across all customers (including Chef’s Circle and Chef’s Circle VIP members) — see clause 7.4 below.
7.3 Referral benefits are subject to MYMC’s Referral Program terms and conditions (as updated from time to time), including eligibility, credit issuance, expiry, and fair use requirements.
7.4 Referral credits are capped at 50 successful referrals per customer within any 12-month period. This cap applies equally to all customers, regardless of Chef’s Circle tier.
8. Priority Customer Support
8.1 Chef’s Circle members may receive priority customer support.
8.2 This means that, where possible, customer enquiries from Chef’s Circle members are prioritised ahead of standard support requests and handled with increased urgency.
8.3 However:
- Response and resolution times are not guaranteed; and
- Service levels may vary based on demand and operational capacity.
8.4 MYMC reserves the right to modify priority support service levels at any time.
9. Program Changes & Availability
9.1 MYMC may, at its sole discretion:
- Modify, suspend, or terminate the Chef’s Circle Program;
- Change tier thresholds, benefits, or eligibility criteria; and
- Limit or revoke membership.
9.2 Any changes may take effect immediately unless otherwise stated.
10. Misuse & Fair Use
10.1 The Chef’s Circle Program is intended for genuine personal use.
10.2 MYMC may withhold benefits, revoke membership, or suspend or terminate accounts where it reasonably believes a customer has:
- Abused or manipulated the program;
- Engaged in fraudulent activity; or
- Breached these Terms or MYMC’s standard Terms & Conditions.
11. Interaction with Credits & Other Programs
11.1 Benefits provided under the Chef’s Circle Program are separate from:
- Cashback programs;
- Promotional credits; and
- Customer service credits or guarantees.
11.2 Each benefit type may be governed by separate terms, conditions, and expiry rules.
12. Privacy
12.1 MYMC will handle personal information collected in connection with the Chef’s Circle Program in accordance with MYMC’s Privacy Policy, available at www.mymusclechef.com/privacy.
12.2 By participating in the Chef’s Circle Program (including through automatic enrolment on meeting the qualifying criteria), members consent to MYMC:
- Using their personal information to administer the program, including assessing qualifying spend, issuing benefits and communicating about the program; and
- Contacting them from time to time (by email, SMS, in-app notification or other electronic means) with tier-based communications, including surveys, tastings, feedback requests and campaign-based offers.
12.3 Members may opt out of program-related marketing communications at any time in accordance with the unsubscribe mechanisms set out in MYMC’s Privacy Policy and standard Terms & Conditions. Opting out of marketing communications does not affect a member’s participation in the program itself.
13. Liability
13.1 The exclusions and limitations of liability set out in MYMC’s standard Terms & Conditions (including the limitation of MYMC’s liability in respect of any claim and the exclusion of indirect, special, consequential and similar loss) apply to the Chef’s Circle Program and are incorporated into these Terms by reference.
13.2 Without limiting clause 13.1, to the extent permitted by law, MYMC is not liable for:
- Any loss arising from program changes, including changes to tier thresholds, benefits or eligibility criteria;
- Any unavailability of, or delay in providing, benefits under the program; or
- Any loss or damage arising from the suspension, termination or withdrawal of the program.
13.3 Nothing in these Terms excludes, restricts or modifies any rights or remedies a customer has under the Australian Consumer Law or any other law which cannot lawfully be excluded, restricted or modified.
14. General
14.1 Eligible customers are automatically included in the Chef’s Circle Program upon meeting the qualifying criteria. No separate enrolment or acceptance is required. MYMC may include or remove customers from the program at its discretion in accordance with these Terms.
14.2 Participation in the Chef’s Circle Program does not require any additional membership fee beyond standard purchases made through the MYMC platform.
14.3 These Terms are governed by the laws of New South Wales, Australia, and each party submits to the non-exclusive jurisdiction of the courts of New South Wales.
